What is a Notice of Violation?

  • A written complaint, alleging a violation of the Zoning Ordinance or the Building and Safety Codes.
  • Code Compliance Officer is the Code Enforcement Officer or Building Inspector authorized to inspect property or to deliver Notices of Violation.
  • A notice of Administrative Hearing to be held before the Hearing Officer.
  • A Hearing Officer is appointed by the Board of Supervisors to adjudicate cases.
  • The owner, tenant, or party who controls a parcel is responsible for a parcel of property that is subject to a Notice of Violation.
  • A judgement is the written decision of the Hearing Officer.
  • Civil Penalties assessed by the Hearing Officer are imposed on the part issued the Notice of Violation.
  • If cited party fails to appear at the hearing, the Hearing Officer will find the owner in default and enter judgement.
  • Compliance is correcting a violation by meeting the applicable requirements of the Zoning Ordinance or Building and Safety Codes.
